2. Description of Services

Local Growth Solutions provides AI-powered voice agent services that answer phone calls, book appointments, and handle customer inquiries on behalf of your business. Our services include:

  • 24/7 AI Voice Call Answering
  • Automated Appointment Booking
  • SMS Notifications
  • Call Recording and Transcription
  • Dashboard Analytics
  • Calendar Integration

3. Account Registration

To use our services, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Be responsible for all activities under your account

4. Subscription and Payment

4.1 Billing: Subscription fees are billed monthly or annually in advance. All payments are processed through Ko-fi or other authorized payment processors.

4.2 Refunds: We offer a 7-day money-back guarantee for new subscribers. After this period, payments are non-refundable.

4.3 Overage Charges: If you exceed your plan's included minutes, additional usage will be billed at $0.50 per minute.

4.4 Cancellation: You may cancel your subscription at any time. Your service will continue until the end of the current billing period.

5. Acceptable Use Policy

You agree NOT to use our services to:

  • Violate any applicable laws or regulations
  • Engage in fraudulent, deceptive, or misleading activities
  • Transmit spam, unsolicited communications, or robocalls
  • Harass, abuse, or harm other individuals
  • Impersonate any person or entity
  • Interfere with or disrupt our services or servers
  • Attempt to gain unauthorized access to our systems
  • Use the service for illegal telemarketing or scam operations

6. Intellectual Property

All content, features, and functionality of our services, including but not limited to software, text, graphics, logos, and AI technology, are owned by Local Growth Solutions and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our services.

7. Call Recording Disclosure

Our AI agents may record calls for quality assurance and service improvement. You are responsible for ensuring compliance with applicable call recording laws in your jurisdiction, including obtaining necessary consents from callers where required.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our services are provided "AS IS" without warranties of any kind
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • We are not responsible for missed calls, booking errors, or AI response inaccuracies

9. Indemnification

You agree to indemnify and hold harmless Local Growth Solutions, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for service interruptions due to factors beyond our control.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the services will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through our services. Your continued use after such modifications constitutes acceptance of the updated Terms.
